Lodging a non-determination appeal takes the decision out of the council's hands entirely — the Inspectorate decides, and the council can then only say what it would have done. That removes your chance to negotiate amendments with the case officer. The PPG actively encourages agreeing an extension of time and working the application to a positive local decision where that is realistic.
